Beyond credit scoring, Annex III also captures AI systems used in other contexts that are common in financial services, including systems used for recruitment of financial professionals, biometric identification for KYC (Know Your Customer) processes, and AI used in the administration of justice or democratic processes where financial institutions play a role.

The high-risk classification for credit scoring AI applies regardless of the underlying technology. Whether a financial institution uses traditional machine learning models, deep neural networks, or large language models for creditworthiness assessment, the same obligations apply under Articles 8 through 15 of the regulation.

High-Risk AI Systems in Financial Services

Credit Scoring and Creditworthiness Assessment

Credit scoring is the most prominent high-risk use case in financial services. The regulation targets any AI system that evaluates a natural person's creditworthiness or establishes a credit score, with the exception of AI systems used for the purpose of detecting financial fraud. This includes:

  • Consumer lending models that assess whether to approve mortgage applications, personal loans, or credit card applications
  • SME lending platforms that use AI to evaluate business loan applications based on the personal credit profiles of business owners
  • Buy-now-pay-later (BNPL) systems that make instant credit decisions at point of sale

For each of these systems, providers must comply with the full set of high-risk requirements: risk management (Article 9), data governance (Article 10), technical documentation (Article 11), record-keeping (Article 12), transparency (Article 13), human oversight (Article 14), and accuracy, robustness, and cybersecurity (Article 15).

Fraud Detection

AI-powered fraud detection systems occupy an interesting position under the EU AI Act. The regulation explicitly carves out fraud detection from the high-risk credit scoring classification under Annex III, point 5(b). However, fraud detection systems may still be subject to obligations under other provisions, particularly transparency requirements and, where they involve biometric data processing, potentially higher-risk classifications.

Financial institutions should carefully assess their fraud detection systems on a case-by-case basis. A system that merely flags suspicious transactions for human review carries different risk implications than one that automatically blocks accounts or reverses transactions.

KYC and Anti-Money Laundering

AI systems used for customer due diligence, identity verification, and anti-money laundering (AML) screening are widespread in financial services. Where these systems involve biometric identification or categorisation — such as facial recognition for remote onboarding — they may be classified as high-risk under Annex III, point 1.

Even where biometrics are not involved, AI-powered KYC and AML systems that determine whether a customer can access financial services have significant implications for individuals' economic participation and may warrant careful risk assessment.

Interaction with Existing Financial Regulation

One of the most complex aspects of EU AI Act compliance for financial services is the interaction with the extensive body of existing financial regulation.

GDPR and Data Protection

The GDPR already imposes significant requirements on automated decision-making in financial services. Article 22 of the GDPR gives individuals the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects. Credit decisions are a prime example.

The EU AI Act adds to these requirements rather than replacing them. Financial institutions must comply with both frameworks simultaneously. In practice, this means that a credit scoring AI system must meet the EU AI Act's requirements for risk management, data governance, and transparency while also satisfying the GDPR's requirements for lawful processing, data subject rights, and data protection impact assessments.

Capital Requirements and Model Risk Management

Banks operating under CRD/CRR frameworks already maintain model risk management programmes for their internal models. The EU AI Act's requirements for risk management (Article 9) and technical documentation (Article 11) overlap significantly with existing model validation practices. However, the AI Act's requirements are broader in some respects — particularly around data governance, bias detection, and human oversight — and narrower in others.

Key Compliance Requirements for Financial Institutions

Data Governance and Bias Prevention

Article 10 of the EU AI Act imposes detailed requirements on training, validation, and testing data. For financial institutions, this has particular implications for credit scoring models:

Bias detection and mitigation: Credit scoring models must be assessed for biases that could lead to discrimination based on protected characteristics such as race, gender, age, or disability. Article 10(2)(f) requires examination for possible biases that could "lead to discrimination prohibited under Union law."

  • Credit decisions must be explainable. Financial institutions must be able to articulate the main factors contributing to a credit decision in terms that both the deployer (the bank or lender) and ultimately the affected individual can understand.
  • Model documentation must include information about the system's accuracy, the metrics used to measure it, and known limitations.
  • Instructions for use must enable bank staff to understand when and how to exercise human oversight over the system's outputs.

Human Oversight

Article 14 requires that high-risk AI systems be designed for effective human oversight. In the financial services context, this means:

  • Credit officers or lending managers must have the ability to override AI-generated credit decisions.
  • Staff responsible for overseeing credit scoring systems must be properly trained to understand the system's outputs, limitations, and potential failure modes.
  • Institutions must actively counteract automation bias — the tendency of human reviewers to defer to the AI system's recommendation without independent assessment.

Record-Keeping and Audit Trails

Article 12 requires automatic logging of system operations. Financial institutions, which are already accustomed to extensive record-keeping requirements, must ensure that their AI systems generate logs that are sufficient for post-market monitoring and regulatory investigation. This includes recording the inputs, outputs, and relevant operational parameters for each decision made by a high-risk AI system.

Compliance Strategies for Financial Institutions

Conduct a Comprehensive AI Inventory

The first step is to catalogue every AI system in use across the organisation, including systems provided by third-party vendors. For each system, determine whether it falls within a high-risk category under Annex III or under sectoral legislation listed in Annex I. Many financial institutions will find that they operate dozens or even hundreds of AI systems, each requiring individual classification.

Map Against Existing Compliance Frameworks

Financial institutions already operate under extensive regulatory frameworks. Map the EU AI Act's requirements against existing obligations under the GDPR, MiFID II, CRD/CRR, PSD2, and the EBA's guidelines on internal governance and model risk management. This mapping will reveal where existing compliance programmes already satisfy AI Act requirements and where gaps exist.

Establish Cross-Functional Governance

EU AI Act compliance cannot be siloed within the IT or data science team. It requires coordination between risk management, compliance, legal, data science, and business functions. Establish a cross-functional AI governance committee with clear accountability for classification decisions, risk assessments, and ongoing compliance monitoring.

Address the Provider-Deployer Distinction

Financial institutions must carefully consider their role under the EU AI Act. When a bank develops its own credit scoring model, it is the provider and bears the full set of provider obligations. When it deploys a third-party AI system, it is the deployer and must ensure the provider has met its obligations while fulfilling its own deployer requirements under Article 26.

Many financial institutions occupy both roles simultaneously — providing some AI systems and deploying others. Contract terms with AI vendors must be updated to ensure adequate allocation of responsibilities and access to technical documentation, logs, and other information required for compliance.

The EU AI Act's obligations apply to the entire lifecycle of AI systems. Financial institutions must establish post-market monitoring programmes for their high-risk AI systems and be prepared to report serious incidents to competent authorities under Article 73. A credit scoring model that was compliant at deployment may drift out of compliance as data distributions change or as new biases emerge.

Prepare for Conformity Assessment

High-risk AI systems in financial services will require conformity assessment before they can be placed on the market or put into service. For most financial AI systems (those listed in Annex III), providers may conduct this assessment through internal control procedures (Annex VI). However, the assessment must be based on a quality management system and thorough technical documentation, both of which take time to develop.

Timeline and Practical Considerations

The EU AI Act entered into force on 1 August 2024. The prohibitions on unacceptable-risk AI practices applied from 2 February 2025. The obligations for high-risk AI systems listed in Annex III — which includes credit scoring — apply from 2 August 2026.

Financial institutions should not wait until the deadline approaches. The depth of the requirements, combined with the complexity of integrating them with existing financial regulation, means that compliance programmes should already be well under way. Institutions that begin now will have time to conduct thorough AI inventories, address data governance gaps, build documentation practices, and train staff on human oversight responsibilities.
