EU AI Act Compliance for the Legal Sector

How the EU AI Act impacts legal tech — AI in case analysis, contract review, judicial decision-making, and legal research. Compliance requirements for law firms and legal tech providers.

The legal sector has seen rapid adoption of AI technologies in recent years. Tools for contract review, legal research, case prediction, due diligence, and document drafting are now part of daily practice at law firms, corporate legal departments, and public institutions. The EU AI Act (Regulation 2024/1689) has particular relevance for this sector, as certain legal AI applications are explicitly classified as high-risk, while others raise important questions about transparency, accuracy, and professional responsibility.

This article examines how the EU AI Act applies to AI in the legal sector, which applications carry the highest compliance burden, and what law firms, legal tech providers, and judicial institutions need to do to prepare.

High-Risk AI in the Administration of Justice

The EU AI Act takes an especially firm stance on AI used in judicial and quasi-judicial contexts. Annex III, point 8 classifies the following as high-risk AI systems:

(a) AI systems intended to be used by a judicial authority or on their behalf to assist in researching and interpreting facts and the law and in applying the law to a concrete set of facts, or to be used in a similar way in alternative dispute resolution.

(b) AI systems intended to be used for influencing the outcome of an election or referendum, or the voting behaviour of natural persons in the exercise of their vote in elections or referenda. (This is less relevant to legal practice but included here for completeness.)

The classification under point 8(a) is broad and consequential. It captures AI systems used by courts, tribunals, arbitration panels, and mediation services to assist with legal research, case analysis, fact-finding, and the application of law. Any AI tool used by or on behalf of a judicial authority in these functions must comply with the full set of high-risk requirements under Articles 8 through 15.

The phrase "on behalf of" a judicial authority extends the scope beyond systems used directly by judges. AI tools operated by court staff, judicial assistants, or outsourced legal research services that support judicial decision-making may all fall within this high-risk classification.

What This Means for Courts and Tribunals

Judicial institutions that adopt AI tools for case management, legal research, or decision support must ensure these systems meet the EU AI Act's high-risk requirements. This includes:

  • Risk management: Systematic identification and mitigation of risks, including the risk of biased or inaccurate legal analysis that could affect judicial outcomes.
  • Data governance: Ensuring that training data is representative and free from biases that could systematically favour or disfavour particular types of litigants.
  • Transparency: Judges and court staff must be able to understand how the AI system arrived at its outputs and assess their reliability.
  • Human oversight: The system must be designed so that judicial officers can override or disregard AI outputs. AI must remain a tool that assists human judgment, never a substitute for it.
  • Record-keeping: Automated logs of the system's operations must be maintained for accountability and potential appellate review.

Contract Review and Due Diligence

AI-powered contract review tools are among the most widely adopted legal tech applications. These systems analyse contracts to identify key terms, flag risks, detect deviations from standard clauses, and extract relevant data points during due diligence processes.

Under the EU AI Act, contract review AI used within law firms or corporate legal departments is generally not classified as high-risk under Annex III, point 8(a), because it is not being used by or on behalf of a judicial authority. However, this does not mean it is unregulated. Several considerations apply:

Transparency obligations: If an AI system is a general-purpose AI (GPAI) model — such as a large language model integrated into a contract review platform — the GPAI model provider must comply with the transparency obligations in Article 53. This includes making publicly available a sufficiently detailed summary of the content used for training and complying with EU copyright law.

Limited risk obligations: AI systems that interact directly with natural persons may be subject to transparency obligations under Article 50, which requires that individuals be informed when they are interacting with an AI system. If a contract review tool generates outputs that are presented to counterparties as human work product, disclosure obligations may apply.

Professional responsibility: Even where the EU AI Act does not impose high-risk requirements, lawyers have professional and ethical obligations to ensure the accuracy and reliability of work product generated with AI assistance. Bar associations across the EU are developing guidance on the responsible use of AI in legal practice.

A contract review AI that produces inaccurate analysis can lead to material legal errors with significant financial and legal consequences. Even where the EU AI Act does not classify such systems as high-risk, law firms should apply rigorous quality controls, including human review of AI-generated analysis before it is relied upon or shared with clients.

AI-powered legal research tools that search case law, statutes, and legal commentary are becoming standard in legal practice. These tools vary widely in their capabilities — from keyword-enhanced search engines to generative AI systems that synthesise legal analysis and draft memoranda.

The classification of legal research AI depends on the context of use:

  • When used by or on behalf of a judicial authority, legal research AI is high-risk under Annex III, point 8(a).
  • When used by law firms for their own research, the system is generally not high-risk under Annex III, but the provider may still have obligations depending on the underlying technology (such as GPAI transparency requirements).

Regardless of classification, the reliability of legal research AI is a matter of professional competence. The well-documented phenomenon of AI "hallucinations" — where generative AI systems produce plausible but fabricated legal citations — poses a serious risk to legal practitioners. Several high-profile incidents have already demonstrated the consequences of relying on AI-generated legal research without verification.

Case Prediction and Litigation Analytics

AI systems that predict case outcomes, assess litigation risk, or estimate damages raise particular concerns. When used by judicial authorities, these are clearly high-risk. When used by law firms to advise clients, the classification is less clear-cut, but the potential impact on access to justice and legal outcomes makes rigorous oversight essential.

If a case prediction tool systematically produces biased results — for instance, by predicting lower success rates for claims brought by certain demographic groups — it could undermine equal access to justice, even when used in a purely advisory capacity by a law firm.

While most legal AI applications fall into the high-risk or lower-risk categories, legal sector participants should be aware of prohibited AI practices under Article 5 that could be relevant:

Social scoring: AI systems that evaluate or classify natural persons based on their social behaviour or personal characteristics in ways that lead to detrimental treatment are prohibited. Legal analytics tools that rate individuals' "litigiousness" or "compliance risk" based on personal characteristics could, depending on their design and use, approach this boundary.

Manipulation and exploitation: AI systems that deploy subliminal techniques or exploit vulnerabilities to materially distort behaviour are prohibited. While this is unlikely to apply to mainstream legal tech, it is relevant to AI systems used in negotiation, mediation, or settlement contexts that might be designed to manipulate opposing parties.

The EU AI Act distinguishes between providers (those who develop or place AI systems on the market) and deployers (those who use AI systems in a professional capacity). This distinction is critical for the legal sector.

Companies that develop and sell AI-powered legal tools are providers under the EU AI Act. If their tools are intended for use by judicial authorities or on their behalf, the tools are high-risk and the providers must comply with the full set of requirements under Articles 8 through 15, including risk management, data governance, technical documentation, transparency, human oversight, and accuracy requirements.

Providers must also conduct conformity assessments (Article 43), issue EU declarations of conformity (Article 47), and register their high-risk systems in the EU database (Article 49).

Law Firms and Courts as Deployers

Law firms and judicial institutions that use AI tools are deployers. Their obligations under Article 26 include:

  • Using AI systems in accordance with the provider's instructions for use
  • Assigning competent personnel to exercise human oversight
  • Monitoring the AI system's operation and suspending use if risks emerge
  • Retaining automatically generated logs for at least six months
  • Informing individuals who are subject to decisions made or assisted by the AI system, where required

For public law bodies — including courts and government legal departments — Article 27 requires a fundamental rights impact assessment before deploying high-risk AI systems. This is a significant additional obligation that requires a structured assessment of how the AI system may affect individuals' fundamental rights, including the right to a fair trial, non-discrimination, and effective remedy.

The fundamental rights impact assessment under Article 27 is distinct from the data protection impact assessment (DPIA) required under the GDPR. However, Article 27(4) permits the AI Act assessment to be conducted in conjunction with the DPIA, which can reduce duplication.

Article 4 of the EU AI Act requires that providers and deployers of AI systems ensure that their staff and other persons dealing with the operation and use of AI systems on their behalf have a sufficient level of AI literacy, taking into account their technical knowledge, experience, education, and training, as well as the context in which the AI systems are to be used.

For the legal sector, this has specific implications:

  • Law firms must ensure that lawyers and support staff who use AI tools understand the capabilities, limitations, and risks of those tools. This is not merely a regulatory requirement but a matter of professional competence.
  • Judicial institutions must ensure that judges, clerks, and other court staff who interact with AI systems understand how those systems work and what their limitations are.
  • Legal education institutions should consider integrating AI literacy into their curricula, as future lawyers and judges will increasingly encounter AI systems in their professional lives.

The AI literacy obligation under Article 4 applied from 2 February 2025, making it one of the earliest provisions to take effect.

Classify your products carefully: Determine whether your AI tools are intended for use by judicial authorities or on their behalf. If so, they are high-risk and require full compliance with Articles 8 through 15. Even if not, assess whether other high-risk classifications apply and ensure compliance with applicable transparency obligations.

Build transparency and explainability into your products: Legal professionals need to understand how AI tools arrive at their outputs. Design your products to provide clear explanations of their reasoning, confidence levels, and limitations.

Document training data and methodology: Maintain detailed records of the data used to train your AI systems, the methodology applied, and the validation and testing performed. This documentation is required for high-risk systems and is good practice for all legal AI products.

Address hallucination risk: If your product uses generative AI, implement safeguards against fabricated outputs. Provide verifiable citations, link to source materials, and clearly communicate the risk of inaccuracies to users.

Conduct an AI inventory: Catalogue all AI tools in use, including those embedded in broader platforms such as document management systems or e-discovery tools. Assess each tool's classification under the EU AI Act.

Establish usage policies: Develop clear policies governing the use of AI in legal practice, including requirements for human review, client disclosure, and quality control.

Train your lawyers: Invest in AI literacy training that goes beyond general awareness to include practical guidance on the specific tools in use, their limitations, and the regulatory requirements that apply.

Review vendor contracts: Ensure that contracts with legal tech vendors include provisions for compliance information, access to documentation, and ongoing support for deployer obligations.

For Judicial Institutions

Proceed with caution: Given the high-risk classification and the fundamental rights implications, judicial institutions should take a careful, deliberate approach to AI adoption. Pilot programmes with robust evaluation frameworks are preferable to rapid, broad deployment.

Conduct fundamental rights impact assessments: Before deploying any high-risk AI system, conduct the assessment required by Article 27, paying particular attention to impacts on the right to a fair trial, non-discrimination, and effective remedy.

Maintain judicial independence: Ensure that AI tools support rather than supplant judicial judgment. Design workflows so that AI outputs inform but do not determine judicial decisions.

The EU AI Act places the legal sector at a critical intersection of AI regulation and the rule of law. AI systems used by or on behalf of judicial authorities face the most demanding compliance requirements, reflecting the fundamental importance of fairness, transparency, and human judgment in the administration of justice. Legal tech providers, law firms, and judicial institutions must all understand their roles and obligations under the regulation.

For the legal sector, compliance with the EU AI Act is not merely a regulatory exercise — it is an opportunity to establish standards for the responsible use of AI in a domain where accuracy, fairness, and accountability are not just legal requirements but professional imperatives. The profession that interprets and applies the law must lead by example in complying with it.
